Divorce Means All Cards are on the Table

Most civil law cases play out like a poker game. Both sides keep their cards close, bluffing about what they have. Only when they are specifically asked do they have to lay their cards down on the table and let the other side know what they have.

Divorce is not a poker game. In San Jose and throughout California, the law requires that you put all your cards on the table. You are legally required to voluntarily disclose information about all of your assets. Your former spouse is required to do the same.

Disclosure Requirements and Property Division

Within 30 days of filing for divorce, each side must disclose complete information about assets, debts and income. This information must be accurate.

Why is it Important to Follow Disclosure Requirements?

California law states that, at a minimum, there must be a preliminary and a final declaration of disclosure. These must put forth the financial information in detail, complete with copies of all relevant financial documents.

Failure to comply with the disclosure requirements during the divorce can have a serious impact. If it is discovered that the other side did not follow the rules, all or part of the final divorce judgment may be set aside. I will stand beside you to pursue the property division results you deserve as outlined by the law.
